3. General principles

3.1 Which data is collected and from whom

Primarily, personal data processed is data you provide yourself or that is collected during the operation of the website. In some cases, personal data may also come from third parties. These may include the following categories:

  • Personal master data (name, address, date of birth, etc.);
  • Contact data (mobile number, email address, etc.);
  • Financial data (e.g. account information);
  • Online identifiers (e.g. cookie ID, IP addresses);
  • Location and traffic data;
  • Audio and image recordings;
  • Special categories of data (e.g. biometric data or information about your health).

3.2 Under what conditions data is processed

Data is treated confidentially and according to the purposes defined in this privacy policy. Transparent and proportionate processing is ensured.

If, in exceptional cases, these principles cannot be adhered to, data processing may still be lawful if there is a justification. In particular, the following may serve as justification:

  • Your consent;
  • The performance of a contract or pre-contractual measures;
  • Legitimate interests, provided your interests do not prevail.

3.3 Withdrawal of your consent

If you have given consent for the processing of your personal data for specific purposes, processing will be carried out within the scope of this consent, unless another justification exists.

You can withdraw your consent at any time by sending an email to the address stated in the imprint. Data processing that has already taken place remains unaffected.

3.4 Disclosure of data to third parties

a. Principle

It may be necessary to use the services of third parties or affiliated companies and to commission them with the processing of your data (so-called processors). Categories of recipients include in particular:

  • Accounting, fiduciary and auditing companies;
  • Consulting firms (legal advice, tax, etc.);
  • IT service providers (web hosting, support, cloud services, website design, etc.);
  • Payment service providers;
  • Providers of tracking, conversion, and advertising services.

It is ensured that these third parties and affiliated companies comply with data protection requirements and treat your personal data confidentially.

In some cases, there may be an obligation to disclose personal data to authorities.

b. Visiting social media channels

The website may contain links to social media channels. This is always visible (typically via corresponding icons). If you click on the icons, you will be redirected to the respective social media channels.

The social media providers will then know that you are accessing their platform from the website. The social media providers may use the collected data for their own purposes. Please note that there is no knowledge of the content of the transmitted data or its use by the operators.

c. Transfer abroad

As part of order processing, your personal data may be transferred to companies abroad. These companies are obliged to comply with data protection to the same extent. The transfer can take place worldwide.

If the level of data protection does not correspond to that of Switzerland, a prior risk assessment is carried out and it is contractually ensured that the same protection as in Switzerland is guaranteed (e.g. using the new standard contractual clauses of the EU Commission or other legally required measures). If the risk assessment is negative, additional technical measures are taken to protect your data. The EU Commission's standard contractual clauses can be accessed via the following link.

3.5 Data retention period

Personal data is only stored as long as necessary to fulfill the respective purposes for which it was collected.

Data stored when visiting the website is retained for twelve months. An exception applies to analysis and tracking data, which may be stored longer.

Contract data is stored for a longer period as required by law. In particular, business correspondence, concluded contracts, and accounting documents must be kept for up to 10 years. As soon as this data is no longer required for the provision of services, it is blocked and only used for accounting and tax purposes.

3.6 Protection of data

Your data is stored securely and all reasonable measures are taken to protect the data from loss, access, misuse, or alteration.

Contractual partners and employees who have access to the data are obliged to comply with data protection regulations. In some cases, it may be necessary to forward inquiries to affiliated companies. In these cases, too, the data is treated confidentially.

Within the website, the SSL (Secure Socket Layer) procedure is used in connection with the highest level of encryption supported by your browser.

3.7 Your rights

a. Right to information

You can request information about the stored data at any time. The request for information must be sent together with proof of identity to info@cjm-consulting.ch.

You also have the right to receive your data in a common file format if the data is processed automatically and if:

  • You have given your consent for the processing of this data; or
  • You have provided data in connection with the conclusion or execution of a contract.

The provision or release of information may be restricted or refused if legal obligations, legitimate own or public interests, or interests of a third party conflict.

The processing of the request is subject to the statutory processing period of 30 days. This period may be extended in the case of a high volume of inquiries, for legal or technical reasons, or if information is missing. You will be informed of any extension of the deadline in text form in good time.

b. Deletion and correction

You can request the deletion or correction of your data at any time. The request may be refused if legal regulations require longer or unchanged retention or if there is a legal justification.

Please note that exercising your rights may conflict with contractual agreements and may have corresponding effects on the execution of the contract (e.g. premature termination of the contract or costs).

c. Legal recourse

Data subjects have the right to enforce their rights in court or to file a complaint with the competent supervisory authority. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner: https://www.edoeb.admin.ch

3.8 Changes to the privacy policy
